Terms of Service

1. General Provisions and Acceptance of the Agreement

These Terms of Service (the «Agreement») govern the use of the Kinobaza mobile application (the «Application» or «Service») — a marketplace for castings and film production services. The Service is operated by J-19 group LLP, BIN 190540021304, registered address: Republic of Kazakhstan, Almaty, Alatau district, Akbulak microdistrict, Sharipova St. 157, postal code 160600 (the «Operator», «we»).

The Service is available in Russian, English, Kazakh and Uzbek and is intended for users in the Republic of Kazakhstan.

By using the Application, registering an account or providing the relevant consents during registration, you confirm that you have read, understood and fully accept this Agreement. If you do not agree with the terms of this Agreement, do not use the Service.

During registration you provide separate consents, including: to the processing of personal data, to the terms of use, to confirmation of being 18+, to the publication of your profile, to receiving casting notifications, and to the use of data for artificial intelligence features.

2. Description of the Service

Kinobaza is a marketplace platform that connects users in the field of film production: clients and service providers. In particular, the Service helps to find and offer:

The Service acts as an intermediary that provides a technological platform for posting offers, searching and connecting users with one another.

3. Eligibility to Use the Service

The Service is intended solely for persons who have reached the age of 18. By registering and using the Application, you confirm that you are at least 18 years old.

You undertake to provide truthful, accurate and up-to-date information about yourself and to keep it current. Providing inaccurate information may result in suspension or termination of access to the Service.

4. Account and Account Security

An account is required to use certain features of the Service. You are responsible for keeping your account login credentials secure and for all actions carried out using your account.

You undertake not to share access to your account with third parties and to notify the Operator immediately of any unauthorized use of your account or any breach of its security.

5. Rules of Use

When using the Service, you must comply with the applicable laws of the Republic of Kazakhstan and with this Agreement.

The rules of conduct, content requirements and the list of prohibited actions are set out in a separate document, the «Community and Content Rules», which forms an integral part of this Agreement. By using the Service, you agree to comply with these rules.

6. User Content and License to the Platform

Users post content on the Service, including cards, media files, portfolios and messages (the «User Content»).

You retain all rights to the User Content you post. By posting content, you grant the Operator a non-exclusive license to store and display such content to the extent necessary for the operation of the Service and the provision of its features.

You warrant that you are entitled to post the User Content and related data, including data of third parties (for example, an agent's contact details), and that you have obtained all necessary consents from such third parties for the posting and processing of their data within the Service.

7. Nature of the Marketplace

The Operator provides an intermediary technological platform and is not a party to any transactions, arrangements or relationships arising between users.

The Operator does not act as an employer in relation to users and does not guarantee the conclusion or performance of any arrangements between users, nor their outcome.

Users independently and at their own responsibility agree on the terms of their interaction and enter into and perform arrangements with one another. Users are themselves responsible for such arrangements and their consequences.

8. Artificial Intelligence Features («DurusAi»)

The Service may provide artificial intelligence features under the name «DurusAi». Such features are provided on an «as is» basis.

The results produced by the AI features may be inaccurate or incomplete and do not constitute professional advice, including legal advice. You use them at your own risk.

9. Payments

The Service does not provide any in-app payment or purchase functionality. Any settlements arising from arrangements between users are made directly between them, outside the Service. The Operator does not take part in such settlements, does not process payments, and is not responsible for them.

10. Platform Intellectual Property

All rights to the Service, including the software, design, interfaces, names, logos and other elements of the Application (other than User Content), belong to the Operator and/or its rights holders and are protected by the applicable laws of the Republic of Kazakhstan.

Use of the Service does not grant you any rights to the said intellectual property, other than the right to use the Service in accordance with this Agreement.

11. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an «as is» and «as available» basis. The Operator does not guarantee uninterrupted or error-free operation of the Service, nor that the Service will meet your expectations.

The Operator is not liable for the actions, content or arrangements of users, or for the results of using the AI features. To the extent permitted by the applicable laws of the Republic of Kazakhstan, the Operator's liability is limited.

12. Suspension and Termination of Access; Account Deletion

The Operator may suspend or terminate your access to the Service in the event of your breach of this Agreement, the «Community and Content Rules», or the applicable laws of the Republic of Kazakhstan.

You may delete your account at any time. The account deletion procedure is described in a separate document and is available in the Application (Profile → Delete Account).

13. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Republic of Kazakhstan.

Disputes arising in connection with this Agreement or the use of the Service shall be resolved in accordance with the applicable laws of the Republic of Kazakhstan. The parties shall seek to resolve disputes through negotiations; if no agreement is reached, the dispute shall be resolved in the manner established by the applicable laws of the Republic of Kazakhstan.

14. Changes to the Agreement

The Operator may make changes to this Agreement. The current version is published in the Application.

Users are notified of changes by means available within the Service. Continued use of the Service after the changes take effect constitutes your acceptance of the updated version of the Agreement.
